TERMS AND CONDITIONS

To be an authorized affiliate of PGN Nutrition, you agree to abide by the terms and conditions contained in this agreement.

Please read this agreement carefully before registering and using the PGN Nutrition Affiliate Program as an affiliate. By signing up for the PGN Nutrition Affiliate Program, you indicate your acceptance of this agreement and its terms and conditions.

The PGN Affiliate Program Offers You:
-2-Tier Commission- 15% commission on all of your sales plus 5% commission on second tier sales.
-FREE membership.
-Monthly commission payouts for balances exceeding $20.
-Sales incentives (free product for hitting certain sales goals)
-Unique Affiliate Marketing Tools such as email templates, business cards, flyers, website banners and more.
-Dedicated Affiliate support.
-Online real-time access to your sales reports, commission and payment history and more.

Joining the PGN Affiliate Program
Your participation in this Program is solely for this purpose: to legally advertise our website to receive a commission on products purchased by individuals referred to the PGN Affiliate Website.

Commission
Commission will be paid once a month. You can not refer yourself or someone living at the same address as you. You will not receive commission on your own account.

Commission Type: 2-Tier: 15% First Tier, 5 % Second Tier
Payout Threshold: $20 Minimum balance required for payout.
Payout Duration: Payments are processed on the first of each month for the previous months’ sales.
Payout Method: PayPal & Check
Please note: You are operating as an independent contractor and will be responsible for all taxes (federal and state).

Revocation of Affiliate Status
Your Affiliate status in the program may be suspended or terminated for any of the following reasons:
-Inappropriate advertisements (Ex: false claims, misleading hyperlinks)
-Spamming (see definition of Spam below)
-Advertising on sites containing or promoting illegal activities.
-Violation of intellectual property act.
PGN reserves the right to terminate an Affiliate account at any time for any reason.

Affiliate Links
You may use graphic and text links both on your website and within in your email messages. You may also advertise the PGN site "offline" in classified ads, magazines, and newspapers. You may use the graphics and text provided to you by us, or you may create your own as long as they are deemed appropriate according to the conditions outlined under “Revocation of Affiliate Status” and have been approved by the Affiliate Program Director (Katie@pgnnutrition.com).

Liability
PGN will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, and any results of "intents of harm" to the Program and/or to our website(s). We make no claim that the operation of the Affiliate Program and/or our website(s) will be error-free and we will not be liable for any interruptions or errors.

Product Disclaimer
The supplements sold as part of the PGN Affiliate Program are not intended to diagnose, treat, prevent, mitigate or cure any diseases.  Sport supplementation should only be used by persons 18 years and older.  If you are pregnant, nursing or have a known medical condition, are under a physician’s care or taking prescription medications, we suggest consulting with your physician before using any nutritional supplement.  In addition, we recommend always consulting your physician prior to beginning or changing any exercise or supplementation program.

Terms of the Agreement
By signing up for The PGN Affiliate Program you understand and agree to be bound by the Terms and Conditions of this membership agreement. The terms of this agreement may be modified by PGN at any time. If any modifications to the terms of this agreement are unacceptable to you, you may terminate your account. Your continued participation in the program will constitute your acceptance of any change. 

SPAM is ANY and ALL unsolicited e-mail or alternative electronic messages.
Any promotion, information, or solicitation sent to a person without their DIRECT prior consent is Spam.
Examples of Spam (consist of, but are NOT limited to):
Any e-message is Spam if sent to a recipient who had previously signed up to receive newsletters, product information, or any other type of e-message, but later opted-out by indicating to the sender they no longer wish to receive additional e-messages.
Any e-message sent to recipients that have had no prior association with the sender or did not DIRECTLY agree to be contacted by the sender is Spam.
Any e-message sent to recipients obtained from "opt-in" lists with whom the sender has no prior association is Spam.
Any e-message sent to a recipient without a clear way for a person to opt-out or request future messages not be sent to them, is Spam.
Any e-message sent or posted via chat rooms, instant messaging systems, newsgroups, message boards, or Usenet is Spam.
